Terms and Conditions of Use – Luca AI Runner (Snowtial, S.L.)

2. Service Description

Luca is an AI-based personal running trainer that interacts with users through the WhatsApp platform, providing training plans, advice, and physical activity tracking.

The service is exclusively oriented to users over 18 years of age.

3. Usage Conditions

• To use the service, the user must accept these Terms and the Privacy Policy.
• The user must provide truthful and updated personal data in the registration process.
• The user agrees to use the service in a diligent, correct and respectful manner.

Snowtial, S.L. may suspend or cancel access to the service if it detects inappropriate or fraudulent use of it.

4. Contracting and Payment Conditions

• The service may require payment of a subscription or a one-time payment, managed through Stripe or other payment platforms.
• The price, frequency and payment method will be clearly indicated before formalizing the contract.
• Prices may be modified after prior communication to the user with a minimum notice of 30 days.

5. Right of Withdrawal

In accordance with Spanish legislation, you have the right to withdraw from the contract within 14 calendar days from contracting.

However, as this is a personalized digital content service that begins immediately after contracting (training personalization), you accept to lose the right of withdrawal once the service execution has begun, in accordance with article 103 m) of Royal Legislative Decree 1/2007.

6. Cancellation and Refunds

• You can cancel your subscription at any time before automatic renewal.
• Cancellations will take effect at the end of the current billing period.
• No refunds will be made for payments already made, except for demonstrated technical error or express agreement of Snowtial, S.L.

7. Responsibility and Medical Exemptions

• Luca provides training recommendations based on data provided by the user, but does not replace medical assessment or professional advice in health or sports.
• Snowtial, S.L. is not responsible for injuries, damages or harm that may result from sports practice based on the training provided.
• Users are recommended to consult with a doctor before starting any physical training program.

8. Intellectual Property

All content generated by Luca, including training plans, recommendations and communications, are the property of Snowtial, S.L. or its licensors.

Their reproduction, distribution, public communication or transformation without the express authorization of Snowtial, S.L. is prohibited.

9. Personal Data Protection

The processing of user personal data will be carried out in accordance with our Privacy Policy.

10. Modifications

Snowtial, S.L. reserves the right to modify these Terms and Conditions at any time.

In case of substantial changes, we will notify users through the usual means of communication (WhatsApp, email, web).

Continued use of the service after changes implies acceptance of the new terms.

11. Applicable legislation and jurisdiction

These Terms and Conditions are governed by Spanish legislation.

In case of controversy, both parties submit to the Courts and Tribunals of Madrid, Spain, expressly waiving any other jurisdiction that may correspond to them.
